Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background
The claimant worked for the respondent as a bar tender from 7/10 2015 until his employment was terminated on 14/02/2016. The claimant was remunerated at a rate of €480 gross for a 40 hour week. The claimant submitted that on the 15th of February he received a phone call from the general manager stated that as of the previous day he was no longer employed by the Briar Rose due to restructuring. The claimant stated he was not paid a weeks notice that he was entitled to.
Findings
The respondent failed to show.
Decision
Based on the uncontested evidence I find the complaint to be well founded and I award him 1 weeks notice of €480 gross.
